MyHublet (Terms of Use) Service Agreement

Welcome to MyHublet!
The following Terms of Service / Use (“Terms”) in the MyHublet Service Agreement (MHSA) are a binding legal agreement between you and MyHublet that govern the use of the website (“Site”), and any MyHublet related services (together with the Site and services, “Service”) made available by the MyHublet entity ( “MyHublet,” “us, “we,” or “our”) with whom you are contracting.

By accessing, using or participating in the Service, you (“you” or the “User”) agree to be bound by these Terms. If you do not agree to these Terms, or are not eligible (see below), you must cease using the Service. If you do not agree to abide by these Terms or are not eligible, you are not authorized to use, access or participate in (or continue to use, access or participate in) the Service.

Eligibility – The Site and Services are intended solely for persons age 18 or older. You must be at least the legal age of majority in your jurisdiction of residence, and able to enter into legally binding contracts in order to access and use the Platform, create an account, or utilize any of the Services. By using the Platform and our Services, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Platform. You represent that you will comply with all export control laws in your local jurisdiction. MyHublet may, to the extent permitted by applicable laws and if we have sufficient information to identify a user, obtain reports from public records of criminal convictions or sex offender registrations of the user., at our sole discretion. You agree and authorize us to use your personal information, such as your full name and date of birth, to obtain such reports, including from vendors. By accessing services, you agree to comply with any rules or requirements applicable above.

We maintain other terms and policies that supplement these Terms like our Privacy Policy, which describes our collection and use of personal data, and our Payments Terms, which govern any payment services provided to users by our third-party payment processor (Stripe).

*Note: We reserve the right to modify, add, or delete portions of these Terms at any time.

Changes to Terms, features, and conditions – Due to the nature of the business, we are continuously improving the Platform for all users and reserve the right at our sole discretion to make changes. Modifications may include, but are not limited to, the Site itself or Services, Terms, including Service Fees, at any time and without prior notice. Changes we make to the Platform, including discontinuing certain features, affect all users and we try to minimize disruption to users. By continuing to access or use the Site or Services after we have posted a modification on the Site or have provided a notice of modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Site and Services.

Section 1: General Service, Terms, and Conditions

1.1 Our Service

MyHublet’s service(s) provide an online peer-to-peer marketplace platform (Site or Platform) to enable its users (hosts, guests) to connect with each other to book Spaces (also known as Properties or Listings) and Services.

MyHublet connects users (hosts and guests) to offer several different host services. The platform provides methods of direct communication, transactions, and other interactions with each other through reserving spaces (“Bookings and Reservations”).

Users who publish and offer services (create “Listings”) are “Hosts” and Users who search for, book, or use services are “Guests.” All Users who have created MyHublet accounts (see Account Registration) are “Members.” The listed venues or properties made available by hosts for guests to rent are referred to as “Spaces, Properties and/or Listings.”

The Platform and Services can be used to facilitate the listing and booking of Spaces. Such spaces are included as Listings on the Site and specific services are offered by Hosts who created the listing. You may view Listings as an unregistered visitor to the Site; however, if you wish to inquire a Space, book a Space or create a Listing, you must become a Member and register a MyHublet account.

THE SITE AND SERVICES ARE INTENDED ONLY TO BE USED TO FACILITATE AMONG HOSTS, GUESTS AND VENDORS CONNECTING AND BOOKING PROPERTIES AND/OR SERVICES DIRECTLY WITH EACH OTHER. MYHUBLET CANNOT AND DOES NOT CONTROL THE CONTENT CONTAINED IN ANY LISTINGS AND THE CONDITION, LEGALITY, SAFETY, OR SUITABILITY OF ANY BOOKINGS. WE DISCLAIM ANY AND ALL LIABILITY RELATED TO ANY AND ALL LISTINGS AND PROPERTIES. ACCORDINGLY, ANY BOOKINGS WILL BE MADE OR ACCEPTED AT THE MEMBER’S OWN RISK. AMONG OTHER THINGS, HOSTS MUST SATISFY THEMSELVES WITH ANY GUEST(S) OR VENDOR(S) AND THEIR CREDENTIALS, AND GUESTS MUST SATISFY THEMSELVES WITH HOSTS AND THE HOSTS’ SPACES. USERS SHOULD NOT COMPLETE, AND SHOULD IMMEDIATELY CANCEL, ANY BOOKING IF THEY FEEL UNSAFE OR UNCOMFORTABLE WITH ANY CONDITIONS RELATING TO THE BOOKING IN ANY WAY. YOU ACKNOWLEDGE AND AGREE THAT YOUR ABILITY TO USE THE SERVICES THROUGH THE PLATFORM DOES NOT ESTABLISH MYHUBLET AS A PROVIDER OF HOST, VENDOR OR ANY OTHER SERVICES.

1.2 General User Terms

It is IMPORTANT for all users to read these terms as they pertain to your legal rights, remedies, and obligations. These include, but not limited to, various limitations and exclusions and obligations to comply with applicable laws and regulations.

Each user is independent, and Hosts and other third-party service vendors (which may be included in “Listings”) are independent contractors, unaffiliated with MyHublet, that are solely responsible for the character, quality, utility and provision of any Space or Vendor Service they provide or do not provide to you.

If you Host, you are responsible for understanding and complying with all laws, rules, regulations and contracts with third parties that apply to your Host Services.

As part of the terms, you understand MyHublet is not a party to any agreements entered between hosts and guests, nor are we a real estate broker, agent, or insurer. MyHublet has no control over the conduct of hosts and guests or other users of the service or any spaces, and disclaims all liability in this regard to the maximum extent permitted by law. Notwithstanding anything to the contrary in these terms of service, no portion of the fees will be deemed to be compensation for anything other than the provision of the service.

These Terms of Service include a release by you of all claims for damages against us that may arise out of your use of the Service. By accessing or using the Service, you are agreeing to this release. This is a contract between MyHublet and the person or entity that registered with MyHublet (“User” or “you”). This Agreement describes the terms and conditions that apply to your use of our service to book or list spaces or other services through our website or apps, and governs your hosting spaces for other users; and establishes the obligations owed between you and MyHublet, and between you and other users.

It is important to understand how the laws work in your respective towns, cities and states. Some cities have laws that restrict their ability for renters paying listers for short-term rentals. Listers should review local laws prior to use of MyHublet’s services.

If you have questions about this Agreement, please contact us. Your use of the Platform or Services constitutes your ongoing acceptance of this Agreement, as amended.

1.3 Account Registration

In order to use many of the MyHublet services, you must register an account to gain full access to Platform services. You must qualify for the eligibility requirements above in order to legally register an account.

By registering an account, you agree to (i) provide accurate, current and complete information about you and your organization as requested by MyHublet (“Registration Data”); (ii) maintain the confidentiality of your password and other information related to the security of your account; (iii) maintain and promptly update the Registration Data and any other information you provide to MyHublet, to keep such information accurate, current and complete; and (iv) be fully responsible for all use of your account and for any actions that take place through your account. You must immediately notify MyHublet if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised.

You represent and warrant that you are not a person or entity barred from using MyHublet or similar platforms under the laws of the United States, your place of residence, or any other applicable jurisdiction. You may not register more than one account or transfer your account to someone else. If and as permitted by applicable law, we may, (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.

1. In order to reserve or otherwise schedule time in a property (a “Space”) from another User through the Service, you must register for a User account.

  1. In order to offer a space for booking or otherwise make your Space available to another User to reserve through the Service, you must register an account.

    You can also register to join by logging into your account with certain third-party/ social networking sites such as Facebook or logging into your Google account. As part of the functionality of the Site and Services, you may link your MyHublet Account with Third-Party Accounts, by either: (i) providing your Third-Party Account login information to MyHublet through the Site or Services; or (ii) allowing MyHublet to access your Third-Party Account, as permitted under the applicable terms and conditions that govern your use of each Third-Party Account. You represent that you are entitled to disclose your Third-Party Account login information to MyHublet and/or grant MyHublet access to your Third-Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account and without obligating MyHublet to pay any fees or making MyHublet subject to any usage limitations imposed by such third-party service providers.

    By granting MyHublet access to any Third-Party Accounts, you understand that we will access, make available and store (if applicable) any Content that you have provided to and stored in your Third-Party Account so that it is available on and through the Site and Services via your MyHublet Account and MyHublet Account profile page. Unless otherwise specified in these Terms, all third-party Content, if any, will be considered to be Member Content for all purposes of these Terms. Depending on the Third-Party Accounts you choose and subject to the privacy settings that you have set in such Third-Party Accounts, personally identifiable information that you post to your Third-Party Accounts will be available on and through your MyHublet account on the Site and Services. Please note that if a Third-Party Account or associated service becomes unavailable for MyHublet’s access to such Third-Party Account is terminated by the third-party service provider, then the Content will no longer be available on and through the Site and Services. You have the ability to disable the connection between your MyHublet Account and your Third-Party Accounts, at any time, by accessing the “Settings” section of the Site. PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD-PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH THIRD-PARTY SERVICE PROVIDERS. MyHublet makes no effort to review any third-party Content for any purpose, including but not limited to for accuracy, legality or non-infringement and MyHublet is not responsible for any third-party Content.

    Section 2: Guest Terms

    2.1 Searching

    You can search for Host listings by using criteria like category, location, and availability. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria. Filters consider factors like keyword, location, category, guest count, availability and more.

    2.2 Booking Request

    Booking requests are when a Guest submits a request on a Listing to book a Space. By sending a booking request, you are agreeing to pay all charges for your booking and any other items identified during checkout such as taxes and fees (collectively, “Total Price”). Custom Booking Requests may contain Applicable Fees and other charges (e.g. an Add On, if applicable) will be shown before you complete your Booking. You are also agreeing that MyHublet’s third-party payment processor, Stripe (see Payment Terms), may charge and collect the amount identified during checkout.

    Guests are encouraged to review the Space Description, applicable services descriptions, and confirm availability prior to booking a Space, Host Services, or Vendor Services. Some Spaces and services may require additional or supplemental verification before a booking request can be approved.

    When you submit a Booking request, you will receive a confirmation email. From here, either your booking request must get accepted and approved by the Host or if the Listing is set up for Instant Booking, the booking will automatically become a confirmed reservation.

    2.3 Approved Bookings and Reservations

    When a booking request is approved or confirmed (sometimes called a Reservation in these Terms), a contract is formed directly between you and the Host. It forms a contractual obligation between users and (i) grants a limited, temporary, revocable license to use a Space, and (ii) if applicable, a contract for Vendor Services, in the manner, for the time, and subject to all restrictions provided, subject to this Agreement, and as confirmed through the Platform. It does not provide you a lease or access or use of the Space beyond the specified time and Description.

    The scope of the use—including times, specific fees, and other additional terms or limitations—may also be included in or supplemented by a separate Booking Agreement that incorporates the terms and conditions of this Agreement and referenced policies. This applies to any additional terms and conditions set forth by the Host, as outlined in their listing description, via messaging, or any supplemental agreements. This should all be provided to you prior to your Booking Confirmation or Reservation.

    The Cancellation Policy (see Cancellation Policy) and any other rules, standards, policies, or requirements identified in the Listing, during checkout, or prior to your reservation, form part of your contract with the Host. Be aware that some Hosts work with a co-host or as part of a team to provide their Host Services.

    The Host retains the right to enter the space during your reservation, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract with the Host, and (iii) consistent with applicable law. If you stay past checkout time, the Host has the right to make you leave in a manner consistent with applicable law, including by imposing reasonable overstay penalties or charges. You may not exceed the maximum number of allowed Guests.

    2.4 Guest Conduct and Responsibility

    You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of your invitees or other individuals to whom you provide access to the Space (collectively referred to as “Attendees or Guests”), excluding the Host and the Host’s invitees, if applicable.

    By booking a Host’s Space, you agree to comply with the Community Guidelines, House Rules and any Booking Agreements throughout the Booking and assure that any attendees do the same. Guests are required to ensure that Attendees meet any requirements for the Space or Event set by the Host, and are made aware of and agree to any terms, conditions, rules, policies, or restrictions set by the Host.

    You agree to use the Space or Vendor Service only as permitted or agreed upon and consistent with the Description.

    Overall Responsibilities:

    (i) Leaving a space (and related personal property) in the condition it was in when you arrived. You agree to return the Space to the Host in substantially the condition as provided to you or as otherwise agreed in any Booking Agreement, consistent with the Community Guidelines. You agree to promptly notify Hosts of any damage done to the Space or Amenities.

    (ii) The behavior and acts of any attendees, service providers, or others that access the Space. You agree that you and your attendees (if applicable) will act with integrity and treat others with respect.

    (iii) Coordinating the timely setup or breakdown of your Event ensuring that the use does not exceed any limitations identified in the Booking.

    (iv) Complying with applicable laws at all times, including acquiring any required licenses or permits for your Event, hiring security personnel for larger Events, legal health-related mandates, or limiting noise to certain times of the day.

    You are responsible for and accept all liability for any damage done to the Space or Amenities during your Event by attendees or service providers whether intentional or not, for your failure to comply with applicable Laws, and for any Fines you incur. All Fines or Fees owed by Guests are subject to Additional Fees (Add On’s), Cancellation and Refund Policy.

    2.5 Circumstantial Responsibilities

    1. Additional Host or Vendor Services. Using additional Host or Vendor Services is a possible add-on as part of your booking. Vendors are independent third-party contractors and are not affiliated with, or under the control of, MyHublet. Vendor or Additional Host Services may be available to Book through the Host’s listing. It is your responsibility to investigate any additional Host or Vendor Services to determine whether they are suitable for you. Subject to applicable law, we are not responsible for and disclaim all responsibility for any liability resulting from Hosts’ or outside Vendors’ actions or failure to act, for the nature or quality of any Services, and for any loss or injury you or others sustain arising out of or related to Hosts and/or Vendors.

  2. Minors. If your guest is a minor or if you bring a minor to a Host Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor and disclose with the host. You agree that you are responsible for ensuring that all minors are accompanied by an adult responsible for them and that you are legally authorized to act on behalf of any minor Attendee.
  3. Alcohol. If your booking includes alcoholic beverages, you are required to notify the host for approval. MyHublet does not produce, distribute or sell alcoholic beverages, but may relay order information to licensed retailers and/or manufacturers (“Licensees”) who may provide for the sale of alcoholic beverages, either as: (i) a Host listing Spaces where alcoholic beverages are sold; (ii) a Host offering Host Services; or (iii) Vendor Services coordinated through Concierge Services. Neither Licensees nor MyHublet sell alcohol to persons under the legal drinking age in the jurisdiction where the Event is held (“Legal Age”).

    By using this Platform for Services related to alcoholic beverages you acknowledge, affirm, and represent to us that you are over the legal age required to buy alcoholic beverages. We make every effort to ensure that alcoholic beverages are not offered, sold, served, or delivered to anyone who is under the Legal Age. By using this Platform, you are acknowledging that the person receiving any shipment of alcoholic beverages from a Licensee is over the Legal Age. You also agree that any alcohol purchased from a Licensee is intended for personal consumption and not for resale. If you cannot make these affirmations and representations or you do not agree with all of these conditions of use, you may not use the Platform and Services. If you misrepresent your age in order to obtain or provide alcohol to a person under the Legal Age, we will report this to the appropriate authorities for prosecution to the fullest extent allowable by law. If we are held liable for any reason based on a misrepresentation of your age, you agree to indemnify us and/or reimburse us for all costs, expenses (including legal fees) and damages we and they suffer or incur.

    2.6 Assumption of Risk

    Your Assumption of Risk. You acknowledge you are responsible for evaluating the description, costs, restrictions, and applicable terms for any Host or additional Vendor Services provided by the Host in connection with a Booking. You are responsible for identifying and complying with all laws, rules, regulations, and restrictions applicable to your use of any of the Host or Vendor Services.

    You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the MyHublet Platform and any use of Host services through the MyHublet Platform. This includes your time at a Host’s space and participation in any activity there, use of any other Host or Vendor Service, or any other interaction you have with other Members whether in person or online.

    2.7 Additional Fees

    As mentioned in the Guest Conduct, you agree to leave the Space no later than the end-time of your Event or at such other time as mutually agreed upon between you and the Host. If you stay past the agreed upon end-time without the Host’s permission, you no longer have a license to use or stay in the Space and the Host is entitled to use lawful means to force you to leave the Space. Additionally, you agree to pay to the Host an overtime charge or equivalent reason of post-reservation charge (“Overtime Charge”) as well as all applicable Guest Fees, Taxes, and other expenses incurred as assessed by the Host.

    We may calculate the Overtime Charges based on your exceeding the time (for example, a calculated hourly rate billed in 30 or 60-minute increments). You may also be charged for other costs associated with exceeding the permitted usage of the Booking (for example, exceeding the number of Event attendees) (“Over Capacity Fees”). MyHublet may charge an additional Service Fee for any Overtime Charges, Damages, or any other charges assessed by the Host using the Platform.     If MyHublet, in its sole discretion, determines that a Host is entitled to additional fees, charges, or damages in accordance with this Service Agreement, the applicable policy set by MyHublet, and/or the terms of the Booking Agreement between the Guest and Host mentioned in the Listing, MyHublet will be entitled to collect any such sums from you required to satisfy the outstanding obligation. MyHublet reserves the right to otherwise collect payment from you and pursue any remedies available to MyHublet in this regard in situations in which you are responsible for fees, charges, or damages, including, but not limited to, in relation to any payment requests made by Hosts.

    2.8 Booking Modifications

    Guests and Hosts are responsible for any booking modifications they agree to make via the Platform or direct MyHublet customer service to make on their behalf (“Booking Modifications”), and agree to pay any additional amounts, fees, or taxes associated with any Booking Modification.

    Section 3: Host Terms

    3.1 Host

    As a Host, MyHublet offers you the opportunity to share your Space with our community of Guests. It’s easy to create a Listing and you are in control of how you host – set your price, availability, and rules for each Listing.

    As a Host, your relationship with MyHublet is that of an independent individual or entity and not an employee, agent, joint venturer, or partner of MyHublet. You agree that Stripe will act as a payment collection agent on behalf of MyHublet as described in the Payments Terms. MyHublet does not direct or control your Host Service, and you agree that you have complete discretion whether and when to provide Host Services, and at what price and on what terms to offer them.

    3.2 Listings

    Any User who has created a MyHublet account (“Member”), may create “Listings.” When you make a Space available for Bookings (“List” a Space), you create a Listing. When you create a listing you are agreeing to become a Host.

    A Listing must provide all required details about a Space – i.e. description, how it may be used, capacity, size, features, cost of Booking, availability, a list of any facilities, rules, and current pictures of the space (collectively, “Description”). This also includes details regarding use of any amenities, furniture, equipment, Host Add-Ons available at an additional charge, or fixtures that are part of or in the Space (collectively, “Amenities”).

    The Description and Amenities must be accurate and give potential Guests a reasonably accurate understanding of how they may use the Space for their Event, including the disclosure of any deficiencies, restrictions, or applicable policies. There must also be a valid physical address associated with the listing. Any terms or conditions included in your Listing must not conflict with the MyHublet Service Agreement or applicable policies unless expressly permitted by MyHublet in writing. For example, you may not (i) modify or expand a Guest’s financial responsibilities or limit a Guest’s ability to seek recourse or restitution under our Terms of Use, (ii) violate the Community Guidelines or Laws, or (iii) require Guests to pay you directly outside the Platform.

    Completed listings will be made available and active via the Site, and agree to any automatic edits or changes to the listing required by MyHublet. Some listings may be subject to approval by MyHublet prior to being made available to book on the platform.

    3.3 Listing Terms and Conditions

    As a Host, you acknowledge and agree that you alone are responsible for any and all Listings and the Content provided accurately represents the space in photos and descriptions. You represent and warrant that you are permitted under applicable Laws to List and confirm a Booking of any Spaces provided, that Spaces comply with applicable Laws, and that you will reasonably facilitate and not obstruct the use of a Space as Booked by a Guest. Hosts acknowledge and agree that they may not List or confirm a Booking for any Spaces that they do not own or for which they do not otherwise have express permission to List. Hosts represent and warrant that they are authorized (e.g., by the owner of any applicable Space) to enter into the MyHublet Service Agreement and participate in all requirements for the Listing, Booking, and collection of Payments, or other terms pertaining to Hosts.

    In addition, you represent and warrant that any Listing you post, any Booking of a Space, or a Guest’s use of a Space will not breach any agreements you have entered into with any third parties, including but not limited to, lease agreements, homeowners associations, condominium associations, facilities managers, property managers, or other agreements, and will comply with all applicable laws, rules, regulations, restrictions (including having permits, licenses, and/or registrations, and laws governing rentals of residential and other properties) or other terms placed on the Space or use of the Space.

    MyHublet assumes no responsibility for a Host’s compliance with any agreements with or duties to third parties, applicable laws, rules and regulations. MyHublet reserves the right, at any time and without prior notice, to remove or disable access to any Listing for any reason, including Listings that MyHublet, in its sole discretion, considers to be objectionable for any reason, in violation of these Terms, or otherwise harmful to the Site or Services.

    If you are a Host or a Lister on behalf of a Host, you understand and agree MyHublet does not act as an insurer or as your contracting agent. If a Guest requests a booking of your Space and you agree, any agreement you enter into with such Guest is between you and the Guest. MyHublet is not a party to it.

    MyHublet makes certain tools available to you to help you to make informed decisions about which Guests you choose to confirm or pre approve for booking of your Space.

    3.4 Bookings

    If a Booking Request is sent for your Space, you will be required to approve the request before it is an actual Booking. Or if you receive an acceptance to a custom offer you have submitted to a Guest, or enable your Listing to be booked without prior approval (“Instant Booking”), then a Booking is automatically approved or confirmed.

    When a booking is requested and must be approved, you must confirm or reject the request within the Booking Request Period, otherwise the booking request will automatically expire. If you are unable to confirm or decide to reject a booking request within the Booking Request Period, any amounts collected by Stripe for the requested booking will be refunded to the applicable Guest.

    If you confirm a booking requested by a Guest, or the booking is automatically approved, you will receive an email, text message or message via the Site confirming the approved booking.

When you accept a booking request, or automatically pre-approve a booking through the MyHublet Platform, you are entering into a legally binding contract directly with the Guest. You are responsible for delivering the Host Space and Service under all the agreed terms and at the price specified in the Booking. You are also agreeing to pay applicable fees like MyHublet’s service fee (and applicable taxes) for each booking.

Any terms, policies or conditions that you include in any supplemental contract with Guests must: (i) be consistent with these Terms, our Policies, and the information provided in your Listing, and (ii) be prominently disclosed in your Listing description.

3.5 Booking Price and Payout

You are solely responsible for setting the Booking Price (including applicable Taxes, Cleaning Fees, and Hosts Services Fees). You may not raise the Booking Price for a particular Guest after the Guest accepts the Booking, but may alter prices based on the addition or deletion of Host Add-Ons prior to the Event.

Stripe will collect the Total Fees and Booking Price from Guests at the time of the booking request or upon the Host’s confirmation and will initiate appropriate distribution (less Service Fee) of funds to the Host within 24 hours of the scheduled check-in time of the Guest.

MyHublet may determine, in its sole discretion, to refund the Guest part or all of the Booking Price in accordance with its policies, which means that where we are required to do so, you may not get all of the Booking Price, and where you don’t, MyHublet will not be liable to you for any portion of the Booking Price that you do not receive.

3.6 Host Responsibilities

Protection. As a Host, you are solely responsible for (i) preserving and protecting your Space and Amenities by removing and/or securing valuable, vulnerable or sensitive items, (ii) determining the appropriate types and intensities of permitted uses in your Space, (iii) evaluating the appropriateness of potential Guests, and (iv) supervising and monitoring the Space and Amenities and your Guest’s use of the Space and Amenities for the Event, to the extent (if any) you as Host determine in your sole judgment.

Laws and Ordinances. You are responsible for ensuring that Spaces and Amenities comply with all applicable Laws including any alcoholic beverage laws, local ordinances related to the condition, licensure, or registration of Spaces for use by Guests, and payment of Taxes. You are also responsible for understanding and complying with any laws, rules, regulations, and contracts with third parties that apply to your Listing. You are responsible to learn what laws, rules, and regulations apply to your Space, the Services you offer, and handling and using personal data of Guests (Privacy Laws). You are responsible for abiding by these laws in accordance with MyHublet’s terms and services. If you have questions about how local laws apply you should always seek legal advice.

Maintenance. You are responsible for maintaining the Space and Amenities so that Guests may reasonably use them as provided in the Description and Booking. Spaces and Amenities must be in good working order and provided to Guests in a safe, clean and usable condition. Any plumbing, electrical, structural or other physical deficiencies or defects must be corrected or disclosed before you List a Space. Except as specified in a Booking Agreement, all water, electricity, HVAC and other utility services (exclusive of telephone and data services) shall be provided with the Space at no additional cost. The condition of the Space must be broom-clean and accurate to its portrayal on your Listings.

3.7 Additional Terms

Hosting as a Team or Organization. If you work with a co-host or host as part of a team, business, or other organization, the entity and each individual who participates in providing Host Services is responsible and liable as a Host under these Terms. If you accept terms or enter into contracts, you represent and warrant that you are authorized to enter into contracts for and bind your team, business or other organization, and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions.

Supplemental Agreements. In certain cases, we may elect to require a supplemental Booking Agreement with your Listing that includes all or part of the Description including a listing of any Amenities and any additional terms and conditions. Where required, the Booking Agreement will incorporate this Agreement and supplement and be a part of the binding agreement between you and a Guest. Except where explicitly approved by MyHublet, Booking Agreements with supplemental clauses may not impose rules or limitations on use that are materially different than those listed in the Description, include any additional contractual obligations, or alter Guests’ or Hosts’ liabilities.

Alcoholic Beverages. If a Host sells alcoholic beverages, the Host represents and warrants that: (a) it holds a valid, current alcoholic beverage license from the state, province, territory, and/or local licensing authorities that permits sales of alcohol directly to consumers; (b) that it currently complies and will comply with all alcoholic beverage laws; and (c) that it is responsible to alcoholic beverage authorities for activities or Bookings made on MyHublet and any orders of alcohol beverages under this Agreement. Host shall maintain all alcoholic beverage permits and licenses necessary and retain order records necessary to provide alcoholic beverage services as required by all applicable alcoholic beverage laws. Host acknowledges and agrees that orders will be fulfilled based on and under its legal rights under its alcoholic beverage licenses.

3.8 Recording

Guest Recording. During their Reservation, you agree Guests may photograph, film, or otherwise record events when using Spaces and Amenities (“Event Recordings”). Except as expressly prohibited by federal, state, provincial, territorial, local or other Laws or as otherwise set forth in the Description or any Booking Agreement, you grant to any Guest that Books a Space a fully-paid, worldwide, non-exclusive, perpetual license to use, copy, transmit, distribute, modify, publicly display, and sublicense Event Recordings that may include or identify the Space or Amenities.

Surveillance Recording. Recording as a Host, if you have any type of security camera, surveillance equipment or other recording device in or around your Space, you are required to disclose it in the Listing, even if it is not turned on or functional. You are also required to disclose how a Guest may be monitored if a recording will take place. Hosts are not permitted to have any security cameras or other recording devices in private spaces, such as bedrooms or bathrooms, regardless of whether they have been disclosed. For the avoidance of doubt, a private space will not include any portion of a Space that has been Booked to carry out a commercial purpose (for example, a photo shoot for bedding which takes place in a bedroom).

3.9 Self-Liability and Assumption of Risk

You acknowledge that hosting carries inherent risks and agree that you assume the entire risk arising out of your access to and use of the MyHublet Platform, offering Host Services, or any interaction you have with other Members whether in person or online. You agree that you have had the opportunity to investigate the MyHublet platform and any laws, rules, regulations, or obligations that may be applicable to your Listings or Host Services and that you are not relying upon any statement of law made by MyHublet. Information we provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations.

Hosts are responsible for their own acts and omissions as well as the acts and omissions of any individuals who work or reside at or are otherwise present at a Space at your request or invitation, excluding the Guest and any individuals the Guest invites to the Space.

As a Host, you may subject to applicable law to terminate an Event or Booking at any time and without advance notice or repayment of any Payments to a Guest if you determine that (i) a Guest has materially misrepresented the proposed Event or Booking; (ii) the Event as actually planned or undertaken is not in compliance with the originally proposed Booking or the terms of this Service Agreement; (iii) permitting the Booking to continue would endanger the safety or security of the Space of your tenants and residents; or (iv) the Booking creates an unreasonable noise, odor, nuisance, or otherwise disturbs the quiet enjoyment of the Space or your tenant’s or your ability to conduct the day-to-day business operations of the Space.

3.10 Host Fees

All Fees owed by Hosts are subject to Fees outlined in the MHSA, Cancellation and Refund Policy. If MyHublet, in its sole discretion, determines that a Guest is entitled to receive a refund in accordance with this Service Agreement, the applicable policy set by MyHublet, and/or the terms of the Booking Agreement between the Guest and Host mentioned in the Listing, after the Host has already been paid, MyHublet will be entitled to recover the amount of any such refund from the Host, including by subtracting such refund amount out from any future payments due to the Host.

3.11 Insurance

As a host, you agree to acquire and maintain all insurance required by Law and suitable for you or your Space. You are solely responsible for understanding and evaluating what insurance is appropriate to cover damage, loss, injury, legal liability, and other harm specific to you, your business, your Guests, third parties, the Space (including personal property within), and deciding what type of coverage, limits and providers are appropriate for you.

We are not required, but may offer suggestions or options for certain insurances by third parties for Events. We cannot assure and expressly disclaim (i) any liability to you or third parties that any insurance offered or acquired will appropriately cover or mitigate risks to you, your business, those attending the Event, third parties, the Space or Amenities, or (ii) endorsement of the quality, character or financial capacity of any insurance company offering insurance products.

Section 4: Payment Terms

4.1 Payment Processing

Please note with respect to use of the Site or any MyHublet Services, the acceptance and exchange of funds between users or MyHublet (“Payment Processing”) is handled by a third-party, “Stripe.”

By using MyHublet’s Site and Services you are agreeing to the terms of the Service Agreement and agree to appoint Stripe as the Limited Payment Collection Agent for Listers and to handle Payment Processing for all services on the MyHublet platform.

In accepting appointment as the limited payment collection agent, MyHublet assumes no liability for any acts or omissions between Collecting Agent and Collecting Users.

For the exchange of funds between users, each Host agrees that payment made by a Guest through Stripe, shall be considered the same as a payment made directly to the Host, and the Host shall make the listed Space available to the Guest in the agreed-upon manner as if the Host received Space rental fees directly.

Your use of Payment Processing on MyHublet is subject to the Stripe Connected Account Agreement that includes the Stripe Services Agreement (collectively, the “Stripe Agreement”).

Operating as a Host or Guest, you agree to be bound by the terms of the MyHublet Service Agreement and the Stripe Services Agreement, as the same may be modified by Stripe from time to time. The Stripe entity with whom you contract will be set out in the Stripe Agreement. As a condition of using MyHublet’s Payment Processing, you must provide accurate and complete information about you and your business and you authorize us to share this information with Stripe. All bank and credit card information is sent directly to and stored with Stripe using their security protocols. MyHublet does not store your payment information on its systems and shall not have any responsibility for the safety or security of that information. Your use of Payment Processing is conditioned upon your compliance with the Stripe Agreement, and if the Stripe Agreement is terminated by Stripe you may not be able to use the Platform, or have your Account suspended or terminated. We may change or add other payment processing services at any time upon notice to you, which may be subject to additional terms or conditions.

4.2 Fees

1. Fees Overview. You understand MyHublet may initiate charges to you for the goods or services you receive. By using our Services, you authorize MyHublet to receive and/or enable your payment of applicable charges for the goods or services (including Third-Party services like Host Services and Vendor Services) obtained through your use of the Platform and Platform Services.

Subject to applicable law, you acknowledge and accept that, as between you and MyHublet, MyHublet may revise charges for any services obtained through use of the Platform at any time in MyHublet’s sole discretion. MyHublet will make reasonable efforts to inform you of the charges incurred through your use of the Platform Services, but you shall be responsible for all charges incurred under your Account regardless of your awareness of such charges. The charges you incur may be owed directly to Third-Party service providers (like Hosts and/or Vendors), and MyHublet will collect those charges from you through Stripe, on the Third-Party’s behalf, and payment of such charges by you will be considered the same as if made directly by you to the Third-Party service provider. MyHublet reserves the right to otherwise collect payment from you and pursue any remedies available to MyHublet in circumstances in which you are deemed liable or owing for any unpaid fees, damages, Fines or other sums for which you are responsible, as decided by MyHublet in its sole discretion and in accordance with this Service Agreement, the applicable policy set by MyHublet, and/or the terms of the Booking Agreement mentioned in the Listing.

1. Booking Costs and Fees. A Booking provides a limited use of a Space or Vendor Service as described in the Listing and Booking Agreement, if applicable, for which the Host charges a fee (the “Processing Fee”). Hosts will be required to either pre-approve, confirm or reject requested bookings within the Booking Request Period otherwise the booking request will automatically expire. If the request automatically expires or the host decides to reject a booking request, the booking fee will be refunded to the Guest. The booking fee may include Host Add-Ons or Services to supplement the use of a Space and shall be processed through the same booking request via the platform. Hosts may charge a Cleaning Fee in association with the use of Space to be included in the Total Processing Fee. The Total Booking Fee will be displayed to the Guest Renter before sending a booking request.

The Limited Payment Collection Agent, Stripe, will act on MyHublet’s behalf to collect Total Booking Fees from Guests at the time of submitting a Booking Request or upon the Host’s confirmation of the request and will initiate payment processing. Stripe may initiate a pre-authorization and/or charge a nominal amount to your Payment Method. If a requested booking is canceled and a refund is due, any amounts collected by Stripe will be refunded to the Guest.

By using the services as a Guest, you agree to pay the Total Booking Fees for any bookings confirmed in connection with your Account. Stripe will collect the total fees pursuant to these terms. Once your confirmed booking transaction is complete, you will receive confirmation emails summarizing payment and your confirmed booking.

1. Additional Fees and Disputes. If you use a Space or Vendor Services beyond that specified in your agreement with another user you will be responsible for payment of additional Fees. “Additional Fees” are incurred post reservation. Additional Fees are determined based on the factors described in the Listing. As a Guest, you are solely responsible for any damage done to the Space or the Amenities by anyone attending or working at your Event. Hosts must notify us within 72 hours of a Guest exceeding the permitted use of the Space and specifically request payment of Additional Fees. Additional Fees request may be processed through Disputes. Users agree that MyHublet may, in its sole discretion, determine whether a Host is entitled to receive Additional Fees in accordance with this Service Agreement, the applicable policy set by MyHublet, and/or the terms of the Booking Agreement between the Guest and Host mentioned in the Listing.

2. Service Fees. For the use of MyHublet’s Platform Services, MyHublet charges Host Fees; Guests are charged Guest Fees, and Vendors are charged Vendor Fees (collectively “Service Fees”). Stripe will collect all Fees on behalf of MyHublet, and where applicable, may also collect Taxes in respect to the Fees. All applicable Service Fees and Taxes will be deducted from Total Booking Fees before dispersing to appropriate parties. MyHublet reserves the right to alter or amend its fees at any time and such changes will become effective after reasonable notice has been given.

4.3 Deposits

When applicable and permissible, certain Bookings may require you to provide a portion of prepaid Fees or a refundable amount (“Deposit”) in advance. Hosts may choose to require deposits for their listings and each listing will note whether a Security Deposit is required for the applicable Space. All Fees and Deposits will be identified prior to completing your Booking. If a deposit is required, Stripe will hold funds on behalf of MyHublet, and at our option, deposits may be credited to your Booking or returned when the Space is returned in acceptable condition and free of any material damage. While we may facilitate the collection of Fees and Deposits for Hosts, subject to applicable law, once remitted to Hosts, we are not responsible for the return of Fees or Deposits to Guests, where applicable.

MyHublet is not responsible for administering or accepting any damage claims made by hosts related to deposits. If a Host claims damage for a confirmed booking of a space where a deposit was required, the Guest will be notified of any Claims (including Damages) through Dispute channel and be given 48 hours to respond. Thereafter, Stripe on behalf of MyHublet will collect any costs against your deposit.

4.4 Taxes

Taxes. Guests and Hosts are solely responsible for payment of all taxes, levies, penalties, and other costs imposed by any taxing authority or government agency related to Listing or Booking Spaces or Vendor Services including any sales or occupancy tax, indirect taxes such as valued added tax (VAT) or goods and services tax (GST), usage or permitting fees, duties, and other taxes imposed by municipalities, states, provinces, territories, or governments through regulation, ordinance, law, or judicial or regulatory interpretation (collectively “Taxes”).

Except as required by Law, MyHublet will not calculate, track or pay Taxes or submit Tax reporting on your behalf. You are responsible for all Taxes owed for Booking or Listing a Space, or providing or using Vendor Services including, without limitation, accurate calculation of Taxes due, timely remittance of Taxes to the appropriate taxing authority and maintenance of any required records and accounts. If any taxing authority demands that we pay such Taxes on your behalf, you are immediately liable to us for such Taxes and will reimburse or pay MyHublet for such Taxes upon demand.

You are also responsible for any penalties arising from your failing to comply with this Service Agreement including those issued by regulatory or taxing authorities, law enforcement, fire code or safety agencies, or other third parties; or that may be issued by us for losses we or users incur that are based on your failing to comply with this Service Agreement or misuse of the Platform, Services, Space, or Vendor Services (collectively, “Fines”). You understand and agree that MyHublet does not provide you with any advice or guidance of any kind or nature regarding Taxes and that you have been advised to consult with your tax advisor for any required advice or guidance regarding Taxes.

Tax regulations may require MyHublet to collect appropriate tax information from our Hosts, or to withhold taxes from payouts to our Hosts, or both. If Hosts are unable to provide us with documentation that we determine to be sufficient to alleviate our obligation (if any) to withhold taxes from payments to you (e.g. where you are a US Host and you fail to provide us with a completed IRS Form W-9), we reserve the right in our sole discretion to freeze all payouts until resolution, to withhold such amounts as required by law, or to do both.

4.5 Penalties and Fines

Users are required to fully pay any Fees, Deposits, Taxes, Fines, or other amounts owed under this Service Agreement. If you owe amounts and we are unable to receive payment through the Platform for any reason, then we may require that you pay through other means (such as direct debit, wire transfer, or cashiers’ check). We may set-off any amounts owed to us through collection of funds that would otherwise be payable to you through the Platform. You are responsible for any costs or expenses associated with our recovering of Fees, Taxes, or Fines owed, including our legal fees or expenses. In our discretion, any late payments of more than 7 days may incur a late charge of up to ten percent (10%) and accumulate interest of twenty-five percent (25%) per annum until delinquency is resolved, or where such amounts are in contravention of local laws, the upper limit of interest that can be reasonably charged on late payments. We may use any legal means available to us to collect delinquent payments, including collections agencies or court filings.

Section 5: Cancellation and Refund Policy
MyHublet implements a site-wide cancellation and refund policy. This policy can be altered at anytime without notices. In effect policy will be displayed on its designated subpage at https://myhublet.com/cancellation-policy/.

5.1 Guest Cancellation Terms

  • Cancellation is within 24 hours of the reservation start date/time:
    • No refund will be issued to the Guest
    • Payment as usual will be issued to the Host
  • Cancellation is within 24 hours AND more than 24 hours before reservation start date/time:
    • Limited refund is issued; Guest will be refunded minus the merchant service fee (appx 3%)
    • If Guest cancels 24 hours within booking date/time and it is not within 24 hours of reservation date/time. Guest will receive full refund minus the merchant service fee (appx 3%)
  • Cancellation is more than 24 hours after booking AND more than 24 hours before reservation start date/time:
    • Partial refund is issued, 50% of the reservation cost minus booking/processing fees will be issued (appx 10%)

5.2 Host Cancellation Terms

  • Cancellation is within 24 hours of the reservation start date/time:
    • Guest will receive 100% refund (reservation cost + processing fee or total booking cost)
    • Host is liable for the merchant service fee (appx 3%)
  • Cancellation is more than 24 hours before the reservation start date/time:
    • Full refund is issued to guest, including processing fees
    • Host is not liable for any fees. (MyHublet assumes the fees)

Section 6: Disputes

As a Member of MyHublet, you have the ability to submit Dispute claims between Users. Disputes may arise out of Contractual Obligations, Reviews, or Damage, Overtime, and other Additional Fees.

6.1 Contractual Obligation Disputes

MyHublet may facilitate the resolution of disputes between users, but does not become a party to any contract by doing so. We are not responsible to you or any Third-Party for providing, or for the condition or nature of, any Space, Host Services, or Vendor Services. Hosts, Guests, and Vendors are independent third-parties and are not affiliated, controlled by, or employed by MyHublet. Hosts and Vendors set their own prices, use their own facilities and resources, and may apply conditions of use to Spaces or Vendor Services as they feel is appropriate for their business. Hosts, Guests, and Vendors are solely responsible for their interactions with each other, and any other parties with whom they interact. MyHublet reserves the right, but has no obligation, to intercede in disputes. Users agree that MyHublet will not be responsible for any liability incurred as the result of such interactions.

6.2 Review Disputes

If a review by a Host or Guest is disputed, MyHublet will consider and determine if it is in violation of MyHublet’s Review Policy and/or Content Policy Guidelines, the review is biased, or irrelevant to the author’s experience.

Factors we consider for Bias disputes prohibit Extortion or Incentivization:
• Guests threatening to use reviews or ratings in an attempt to force a host to provide refunds, additional compensation, or a reciprocal positive review.
• Hosts requiring a guest to leave a positive review or rating, or to revise a review in exchange for a partial or full refund, or a reciprocal review. Hosts also cannot offer a free or discounted rate in exchange for a guest revising an existing review.
• Hosts or guests asking someone to take specific actions related to a review in exchange for the resolution of a dispute.

Factors we do not prohibit:
• A guest from contacting a host with a problem prior to leaving a review.
• A host or guest seeking refunds or additional payment and leaving a review – where that review is not used as a threat to sway the outcome of a resolution.
• A host asking a guest to leave an honest positive review or rating reflecting a positive experience.
• A host or guest from revising a review within the time constraints for revision.

6.3 Dispute of Damage, Overtime, and Other Additional Fees

If a Host provides evidence that another Member damaged their real or personal property (“Damage Claim”), the complaining Member can seek compensation. If a Host provides evidence that a Guest stayed beyond the scheduled allotted time, the Host may seek overtime charges. If there are any additional services or fees the Host claims to be charged, they may seek additional fees.

Host may claim the expenses, and Guests will be given an opportunity to respond. If the responding Member agrees to pay, or MyHublet determines in its sole discretion that they are responsible for the Damage, overtime or additional fees, Stripe (on behalf of MyHublet) will collect any sums required to cover the Damage or additional expenses from the responding Member and/or against any security deposit.

You agree that MyHublet may seek to recover from you under any insurance policies you maintain and that MyHublet may also pursue against you any remedies it may have available under applicable law. You agree to cooperate in good faith, provide any information MyHublet requests, execute documents, and take further reasonable action, in connection with Damage Claims, Member complaints, claims under insurance policies, or other claims related to your provision or use of Host Services.

6.4 Dispute Process

When disputes arise between Users, MyHublet encourages all Users to resolve disputes informally between themselves first. You agree to first attempt to resolve any disputes, disagreements, or claims that you have with other users (each, a “User Dispute”) in good faith through messaging via the Platform. If users are unable to mutually resolve the User Dispute, then either user may submit the User Dispute to MyHublet. Users should notify MyHublet of a potential User Dispute within 72 hours after an Event and document any damage, disputes, statements, or other material facts that may impact a User Dispute and impact the enforcement of any applicable term, policy, or provision.

You may submit your dispute via the Dashboard under the Disputes tab or email us directly at support@MyHublet.com . Where a user is covered by and tenders to supplemental insurance, such insurer may assign an adjuster to review the evidence, and MyHublet will thereafter update the Host and/or Guest’s account in accordance with any determination. Where supplemental insurance is omitted, Users agree to cooperate and assist MyHublet in good faith and to provide such information and take such actions as is requested in connection with the User Dispute.

We will attempt to resolve the User Dispute through communication with the users. If users agree to a resolution, or if MyHublet determines in its sole discretion that a user is responsible for fees, damages, costs, refunds, or other amounts, you agree that MyHublet may collect such amounts from you pursuant to this Service Agreement, any Booking Agreement, or any applicable policy. Users agree, upon MyHublet’s reasonable request, to participate in a mediation or similar dispute resolution process with the other user which process will be conducted either by MyHublet or a Third-Party selected by MyHublet. Users will not be charged for any mediation or resolution process arranged by MyHublet.

Section 7: Platform Terms and Conditions

7.1 Platform Access

You are aware of and abide by all applicable terms, including this Service Agreement when accessing the MyHublet Site or Platform. You are responsible to ensure all persons who have access to the platform through your Internet connection are aware of and abide by these terms as well. Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable license, to (i) access and view any MyHublet Content solely for your personal and non-commercial purposes and (ii) access and view any Member Content to which you are permitted access, solely for your personal and non-commercial purposes. You have no right to sublicense the license rights granted in this section.

We may require additional conditions or requirements to access and use the Platform, or specific areas or features of the Platform, at any time and for any reason. Access to or use of certain features of the Platform may be subject to additional policies or guidelines or may require you to accept additional terms and conditions. In the event of a conflict between this Service Agreement and the additional terms and conditions for a specific area of the Platform, the latter terms and conditions will take precedence with respect to that specific area of the Platform, unless otherwise specified.

7.2 User Content

When using parts of the MyHublet Platform, you may be asked to provide feedback, text, photos, audio, information, and other content (collectively, “Content”). You represent and warrant that you either own the Content or are authorized to provide Content to the Platform and any Content you provide does not violate proprietary or privacy rights of a Third-Party. You are solely responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any Third-Party. You may not provide any Content that is copyrighted by third parties without their express permission.

Content License. By providing Content, in whatever form and through whatever means, you grant MyHublet a non-exclusive, worldwide, fully paid, royalty-free, irrevocable, perpetual, sub-licensable and transferable license to copy, modify, prepare derivative works of, transmit, distribute, publish and otherwise exploit, that Content, without limitation. This grant includes our ability to use any Content for both internal and external use. If you cannot provide us the above license grant then you may not provide Content to us. You agree to indemnify, defend and hold us harmless for any damages or losses based on third-party claims that Content violates proprietary or privacy rights. By submitting or posting Content, you also agree to waive any moral rights in and to such Content.

7.3 User Content Policy Guidelines

By posting content on MyHublet, you agree to abide by our Terms and comply with our Content guidelines below. We reserve the right to remove any content, in whole or part, that violates any of our Guidelines, Terms, or for any other reason at our sole discretion.

The following Guidelines govern our Content Policy:
1. You must own the Content you provide or have authorization to provide it.
2. The Content is accurate and complete. You agree to keep any Content current.
3. The Content you provide must be relevant to your Profile, Listing, Booking, or related subject matter.
4. Any Content deemed as deceptive, fraudulent, false, misleading, or misrepresentative is prohibited.
5. Any obscene, profane, sexually explicit, graphic, or violent Content is prohibited.
6. Content that is viewed as defamatory, threatening, or harassing is prohibited.
7. Content that endorses or promotes illegal or harmful activity is prohibited.
8. Content that violates any applicable laws such as discrimination, false advertising, Privacy, Intellectual Property rights, or unlawful marketing is prohibited.
9. Content that includes sensitive personal, private, or confidential information including payment, contact information, or personal account details is prohibited. You will not knowingly or negligently provide any Content that contains viruses, Trojan horses, and other harmful content (collectively, “Viruses”). While we attempt to identify any Viruses, we are not liable for and disclaim all responsibility for ensuring that Content is free from Viruses.
10. Content solely for the purpose of advertising or other commercial content, including company logos, links, or company names is prohibited. Spam, unwanted contact, or content that is shared repeatedly in a disruptive manner, contains marketing or promotional content unrelated to the details of a certain subject is also prohibited.

In the event of repeated or severe violations, we may suspend or permanently deactivate the account(s) in question. For more details, see Termination/ Suspension and other Measures.

7.4 Review Policy

After each Host Service, Guests and Hosts will have an opportunity to review each other. You may submit feedback to the platform following the completion of a Space booking. As a Host or Guest, You acknowledge and agree that other Users may publicly post ratings and reviews of you or your Space, as applicable.

We ask our Users to help ensure that reviews on MyHublet are useful and informative. Reviews adhere to the same Content Policy Guidelines. You can review MyHublet’s Content Policy Guidelines (Section 7.3) for more details.

1. Reviews should be unbiased and provide objective information. We will disallow individuals or entities who own or are affiliated with a listing to post reviews of their business. We also don’t allow individuals who are confirmed to offer competing Listings to post reviews of their direct competitors. You are also not allowed to incentivize positive reviews, to use the threat of a negative review to manipulate a desired outcome, or to influence another’s review with the promise of compensation. You’re also not allowed to accept fake reservations in exchange for a positive review, use a second account to leave yourself a review, or coordinate with business partners to get positive reviews.

  1. Reviews should be relevant. Keep your reviews relevant to your completed Reservation. Guests are reading your reviews to learn about the host and their listing. Reviews should focus on your time during the reservation. Avoid Content that refers to circumstances entirely outside of another’s control or content about unrelated services (for example, an airline, rideshare, restaurant, etc.). Avoid content about past reservations, hosts, or guests, or about MyHublet’s services where it does not relate to the listing, host or guest you are rating.

    Reviews are meant to help other guests make meaningfully informed booking decisions. That is why we encourage and expect all community members to post reviews that contain objective and accurate information. Reviews that violate any of these policies or terms are subject to removal.

    To report a review for violating any of the Review policies or terms, contact us support@MyHublet.com. Repeated violations may lead to suspension or permanent deactivation of the account(s) responsible for the reviews.

    Additionally, reviews may be removed from the platform for reservations where a significant violation has taken place. This is to help hosts feel more comfortable intervening when a disruptive party takes place, without having to fear a biased review as a result.

    MyHublet is not obligated to, but may monitor such postings. All Reviews are not verified by MyHublet for accuracy and may be incorrect or misleading. MyHublet is not responsible in any manner for such ratings and reviews, and you hereby release MyHublet from any and all claims, causes of actions, obligations or liabilities arising from or relating to such ratings and reviews.

    If you feel a review is untrue, MyHublet doesn’t mediate disputes concerning the truth of reviews. We expect the author of the review to stand behind the content of their review. If you want to respond to a review, find out how.

    7.5 User Conduct and Platform Usage Compliance

    By utilizing MyHublet platform, you are responsible for complying with our User Conduct and Platform Usage guidelines and you may use the Platform and Services only for lawful purposes and in accordance with the entirety of this Service Agreement.

Compliance and Legal Responsibility: You are solely responsible for complying with all applicable laws, rules, regulations, and tax obligations related to your use of the Platform. Follow all laws, including privacy, data protection, and export laws.

Prohibited Conduct:

  1. Misrepresentation: Do not lie, impersonate others, or provide false information (name, phone number, address).
  2. Misuse of Accounts: Do not use or attempt to use another person’s account without authorization, create duplicate accounts if suspended, or create an account if under 18.
  3. Discrimination: Do not discriminate based on race, gender, religion, sexual orientation, disability, age, or any other characteristic protected by law.
  4. Harassment/Abusive Behavior: No harassment, sexually explicit, violent, disruptive, or abusive behavior.
  5. Impersonation and Misleading Information: Do not falsify or misrepresent your affiliation with any entity, including MyHublet.
  6. Misleading Listings/Bookings: Do not provide misleading information on fees, listing descriptions, space conditions, or booking purposes.

Platform Usage and Security:

  1. Permitted Use: Use the Platform only for its intended purpose—Hosts to list spaces and Guests to book spaces. Promotion of products/services outside this is not allowed.
  2. Spam/Unauthorized Payments: No spam, unauthorized promotional materials, or accepting payments outside the Platform.
  3. Account Security: Do not scrape, hack, reverse engineer, or attempt to interfere with the Platform’s functioning or security.
  4. Automated Tools: Do not use bots, crawlers, or other automated means to collect data or interact with the Platform.

Respectful Communication:

  1. Polite Interaction: Be polite, respectful, and responsive in your interactions with others.
  2. Responsiveness: You should be available to answer booking-related questions promptly.

Data Protection and Privacy:

  1. Personal Data: Do not share personal or sensitive information that could lead to fraud or identity theft. We may verify the accuracy of the information you provide.
  2. No Personal Data Sharing: Sharing personal data between users is prohibited and may result in account suspension.

MyHublet Brand and Intellectual Property:

  1. Protect MyHublet’s Reputation: Do not engage in actions that harm MyHublet’s brand, reputation, or intellectual property.
  2. Branding Restrictions: Do not misuse MyHublet’s branding or trademarks, and do not register confusingly similar domain names or handles.

Prohibited Activities:

  1. Unauthorized Events/Parties: You are responsible for any unauthorized parties or events during your reservation.
  2. Prostitution/Human Trafficking: Offering or facilitating illegal activities is strictly prohibited.

Security and Technological Integrity:

  1. No Interference: Do not take actions that impair the performance of the Platform, such as using harmful code, viruses, or denial-of-service attacks.
  2. Restricted Software Use: Do not decompile, disassemble, or reverse engineer any software or hardware related to the Platform.

We reserve the right, but shall not be obligated, to use public and private data sources to validate the accuracy of any Content. This may include validating your identity or business information, or verifying information about Spaces. You will provide us with any additional information to verify the accuracy or completeness of any Content that you provide and we may condition your use of the Platform or Services on our ability to verify the accuracy and completeness of this Content. If you do not provide required verification to us when we request it, we may suspend or terminate your Account, cancel any Bookings you have made or received, withhold payment, and/or impose and collect Fines.

For your protection, you may not share personal or sensitive information about yourself. This includes your home address, phone number, payment information, or other sensitive information that could lead to fraud or identity theft. This may be a safety risk to you and others. You may also not post any details about an ongoing dispute between you and another user.

We may remove communications among users which contain or share personal data, or (ii) suspend or terminate the accounts of users that share personal data.

We are not responsible for, and disclaim all liability resulting from, any losses or harm to you resulting from sharing personal or sensitive data with other users, or communicating or engaging with users outside of the Platform.

7.6 Reporting User Misconduct

If you believe that a Member, Listing or Content has violated our Standards, you should report your concerns to MyHublet. If you believe that a Member, Listing or Content poses an imminent risk of harm to the Platform, a person, or property, you should immediately contact local authorities especially if you suspect laws are broken. If you reported an issue to local authorities, MyHublet may request a copy of that report. Except as required by law, you agree that we are not obligated to take action in response to any report.

MyHublet may preserve and disclose any of your information if we are required to do so by law, or if we believe in good faith that it is reasonably necessary to (i) respond to claims asserted against MyHublet or one of its Users, or to comply with legal process (for example, subpoenas or warrants), (ii) enforce or administer our agreements with users, such as these Terms and Community Guidelines (iii) for fraud prevention, risk assessment, investigation, customer support, product development and de-bugging purposes, or (iv) protect the rights, property or safety of MyHublet, its users, or members of the public.

7.7 Community Guidelines

These guidelines are a non-exhaustive list intended to protect our community. You must agree to the User Conduct and Reservation Guidelines as part of the MHSA, to use the Platform and Services. Please read them carefully and only use the Platform or Services if you agree to abide by them.

Hosts must comply with any Laws, including local zoning, permitting, or tax laws. Zoning and use restrictions are in place to protect people, including your Guests. You know your Space best and Guests trust that your Space is up to code, properly licensed, and safe.

Hosts must practice standard Health & Safety measures. Hosts must provide a safe and clean environment for all bookings. If a Host has elected to provide any enhanced Health and Safety measures, they must mention in the details of their Listing. Hosts that do not abide by the standardized Health & Safety measures may lose certain hosting privileges or have their account terminated.

Guests are required to use Spaces with respect and as described to Hosts. It is important that you are honest and do not misrepresent the intended use of a Space when Booking. It is up to the Hosts to determine how they want (or do not want) their Spaces used.

Guests should never store, transport, or possess hazardous material in a Space. This should go without saying but hazardous material can harm people and do permanent damage to Spaces. Bringing hazardous materials to a Space is not only dangerous but may be illegal, and you could face significant civil liability or criminal action for doing so.

Guests must be respectful and take good care of the space and amenities. Guests should not take property that isn’t theirs, use hosts’ property not included with the booking without their permission, or continue to occupy the space after the booking has concluded without prior approval from a host. Asking for permission ahead of time will limit potential disputes from occurring.

Prohibited Acts:

Discriminate against Hosts or Guests. Discrimination against any other person based on their race, sex, gender, ethnicity, national origin, sexual orientation, disability, or any other legally protected class is illegal and strictly prohibited. If we believe that you have discriminated against another person, we may suspend or terminate your account immediately.

Encourage, endorse, or engage in any illegal activities or dangerous behavior. Hosts and Guests are responsible to report any illegal or dangerous behaviors during their reservations. MyHublet will report all crimes and illegal activity to the proper authorities. Illegal activity may include, but not limited to: sexual/physical assault, sexual abuse, harassment, robbery, human trafficking, kidnapping, or other acts of violence. While use of marijuana is or may become legal in some jurisdictions, where it remains prohibited under national and / or local laws you, or your Guests may not grow, sell, distribute or use marijuana (or any other banned substances), in any Space that is Booked on the Platform.

Harm, intimidate, or threaten Hosts or Guests. You are prohibited from doing anything that may harm or intimidate someone during a reservation that may interfere with their use or operation of the Space. This includes threatening or harassing Hosts or Guests; attempting to extort others for discounts or favorable reviews; or threatening legal action.

Violate others’ privacy. While there is a general expectation of host supervision of space during a booking to maintain safety standards, Hosts must disclose the use of any surveillance cameras in their space and surveillance cameras are not permitted in private areas such as bathrooms or dressing rooms. No one should spy on other people or go into restricted areas without express permission.

Disturb neighbors or common areas. You should not utilize or damage common areas. You should obtain special permits where necessary and make parking arrangements as needed so that it does not impede the access of others in surrounding areas. You should not create a nuisance for those neighboring the space or others around you.

7.8 Reporting Community Guideline Violations

If you feel someone is acting or has acted inappropriately or illegally, including but not limited to anyone who (i) engages in offensive, violent or sexually inappropriate behavior, (ii) you suspect of stealing from you, or (iii) engages in any other disturbing conduct, you should immediately report such person to the appropriate authorities and then to MyHublet by contacting us with your report provided that your report will not obligate us to take any action beyond that required by law (if any) or cause us to incur any liability to you.

Section 8: Termination, Suspension, and other Measures

8.1 Term

The agreement between you and MyHublet reflected by these Terms is effective when you access the MyHublet Platform (for example to create an account) and remains in effect until either you or we terminate the agreement in accordance with these Terms.

8.2 Termination

You may terminate this agreement at any time by sending us an email notice of termination or by deleting your account. You are responsible for all activity associated with your Account made before it is closed including: (i) payment of Fees, Taxes, Fines or other charges; (ii) providing use of Spaces to Guests as previously Booked; or (iii) other liabilities caused by or resulting from use of the Platform or Service. If you have confirmed reservations you are unable to oblige prior to terminating, they will automatically be canceled and any refund will depend upon the terms of the applicable Cancellation policy.

MyHublet may remove your Profile and cease displaying your Profile Content, such as your Space listings if you are a Host and your Collections, on or through the Service. We may retain Content and continue to display and use any public Content (including comments or reviews of Spaces) after your Account is terminated. Termination of your Account does not terminate any contractual arrangements you have with third parties, including any obligations to government entities for tax purposes. Once terminated, your access to, use of, or participation in the Service, including any content therein, may be prevented by MyHublet at any time after your termination of your account.

MyHublet may also terminate this agreement and your account for any reason by giving you 30 days’ notice via email to your registered email address. We also reserve the option to terminate this agreement immediately without notice and stop providing access to the Platform. Subject to applicable law, we may suspend your Account –including your ability to communicate with other users, receive payments, or complete Bookings–or terminate this Agreement and your Account completely at any time based on our sole discretion without limitation for any violations.

8.3 Member Violations

MyHublet may enforce Termination, Suspension or other measures without prior notice for the following Violations:

(i) If you breach these Terms, our Policies, or our Standards, breach the “User Conduct” or “Community Guidelines” provisions, or violate any other rules or policies that govern the use of the Service.
(ii) You violate applicable laws, regulations, or third-party rights.
(iii) Your conduct may harm the platform or other users and potentially incur liability.
(iv) You fail to respond to communications from us or other users; or you receive negative feedback from other users.
(v) If there is evidence of actual or potential fraud by you or on your behalf such as providing inaccurate, fraudulent, outdated or incomplete information during the Registration or Listing process or thereafter.
(vi) MyHublet believes it is reasonably necessary to protect our Platform, its Members, or third parties; or believe that use of your Account poses a risk to us, you, other users, or third parties.
(vii) Or as otherwise determined by MyHublet in its sole discretion.

8.4 Violation Measures

In reference to the Member Violations, MyHublet may deem it necessary to enforce the following measures on your account:

Suspend or limit your access to or use of the MyHublet Platform and/or your account;
Suspend, Remove, or Delay any Listings, Reviews, or other Content;
Cancel pending or confirmed bookings;
Suspend or revoke any special status associated with your account.
Temporarily suspend or Permanently terminate your Account.

For minor violations or where otherwise appropriate as MyHublet determines in its sole discretion, you will be given notice of any intended measure by MyHublet and an opportunity to resolve the issue. You may appeal actions taken by us under this Section by contacting customer service at support@MyHublet.com . If a reservation is canceled under this Section, the amount paid to the Host will be reduced by the amount we refund or otherwise provide to the Guest, and by any other costs we incur as a result of the cancellation.

8.5 Legal Mandates

MyHublet may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, including the measures described above in Section 8.4 .

8.6 Effect of Termination

Hosts who terminate their account or receive a measure of temporary suspension or termination, any pending or accepted future reservations will be automatically canceled and your Guests will receive a full refund for any and all confirmed reservations. You will not be entitled to any compensation for reservations that were canceled as a result of a suspension or termination of your account.

Guests who terminate their account or receive a measure of temporary suspension or termination, any confirmed booking(s) will automatically be canceled and any refund will depend upon the terms of our Cancellation Policy. We may communicate to either Hosts or Guests that such reservations have been canceled.

When this agreement has been terminated, you are not entitled to a restoration of your account or any of your Content. We do not have an obligation to delete or return to you any of your Member Content, including but not limited to any reviews or Feedback. If your access to or use of the MyHublet Platform has been limited, or your MyHublet account has been suspended, or this agreement has been terminated by us, you may not register a new account or access or use the MyHublet Platform through an account of another Member.

8.7 Survival

If you or we terminate this Agreement, the clauses of this Service Agreement that reasonably should survive termination will remain in effect.

Section 9: Copyright Policy and Intellectual Property and Privacy

If you believe that Content on the MyHublet Platform infringes copyrights, please notify us in accordance with our Copyright Policy.

9.1 Notification of Copyright Infringement

MyHublet respects the intellectual property (IP) rights of others and expects its Users of the Service to do the same. It is MyHublet’s policy to disable and/or terminate the account or access of users, when appropriate and at our discretion, who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

MyHublet complies with the federal Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf. We will actively respond to claims of copyright infringement committed using the MyHublet platform, in compliance with the DMCA and other applicable laws, that are properly provided to us. We will remove any content we determine to be infringing with our obligations under the Digital Millennium Copyright Act (DMCA) and the Canadian Copyright Act, the Canadian Copyright Act and the UK’s Copyright, Designs and Patents Act 1998, or any legislation that replaces such acts.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Platform by sending the following DMCA Notice of Alleged Infringement to support@myhublet.com . Once received, MyHublet will internally review alleged violations but may not send you a response each time notifying you of the results of our review. In our sole discretion, if we deem appropriate, we may remove the challenged material from the Platform.

9.2 Drafting a Notice of Alleged Infringement

Please note, any information you provide to us may be shared with other users, third parties, or law enforcement to help assess the claim of infringement or remove infringing content.

If you believe any Content posted on the platform has been copied or used in a way that constitutes copyright infringement, please notify us with the following information:

Identify the copyrighted work that you claim has been infringed, or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. If multiple copyrighted works are covered by this Notice – you will provide a comprehensive list of the copyrighted works that you claim have been infringed or the subject of infringing activity.

Provide information reasonably sufficient to permit us to locate the material, including at minimum, the URL of the link shown on the Site and Application where such material may be found.

Provide your contact information including your mailing address, telephone number, and, if available, email address.

Agree to and include a statement that says “I hereby state that I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”

Agree to and include a statement that says “I hereby state that the information in this notification is accurate and, under penalty of perjury, I am the owner, or authorized to act on behalf of the copyright owner, or of an exclusive right under the copyright that is allegedly infringed.”

Provide your full legal name and your electronic or physical signature of the copyright owner or a person authorized to act on their behalf.

9.3 Counter Notification

If you believe your Content was removed after we received a notice of copyright infringement and is not actually infringing, or that you have the necessary rights to post your Content, please send us a counter-notice containing the following information:

Identify the copyrighted work that was removed due to being the subject of infringing activity or to which access has been disabled.

Provide information reasonably sufficient to permit us to the location at which the Content appeared before it was removed or disabled, including at minimum, the URL of the link shown on the Platform where such material was found.

Provide your contact information including your mailing address, telephone number, and, if available, email address.

Agree to and include a statement that you will accept service of process from the person who provided the original notification of the alleged infringement.

Agree to and include a statement that you have a good faith belief, under penalty of perjury, that the User Content was removed or disabled as a result of mistake or a misidentification of the User Content.

If we receive a counter-notice, we may send a copy of the counter-notice to the person alleging copyright infringement and inform that person that we may replace the removed User Content following a period of deliberation. Unless the original person alleging copyright infringement files an action seeking a court order against the content provider, member or User, the removed User Content may be replaced, in 10 to 14 business days or more after receipt of the counter-notice, at MyHublet’s sole discretion.

Filing a counter-notification may lead to legal proceedings between you and the original claimant to determine ownership. Be aware that there may be adverse legal consequences dependent on your jurisdiction if you make a false or bad faith allegation by using this process.

We reserve the right to remove any Content alleged to be infringing without prior notice and at our sole discretion. In appropriate circumstances, we may also terminate a User’s account if the User is determined to be a repeat infringer.

9.4 Intellectual Property Ownership and License

MyHublet owns all rights, titles, and interests in the Platform and Services, and all intellectual property embodied or contained in them (individually and collectively, “IP”). IP includes all registered or potential patents, copyrights, trademarks, trade secrets, and other proprietary rights. All content on the Platform and otherwise available through the Service, including User Content, are the proprietary property of MyHublet, its Users or its licensors. No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, other than as expressly permitted in these Terms.

Through your Account, we grant you a limited, temporary, revocable, non-transferable, non-exclusive license to use the Platform and Service for the purposes described in this agreement and only as provided to you through the Platform. This license does not constitute a transfer of ownership or grant you any additional rights to use the IP. You may not register, claim ownership in, or sublicense the Platform, Services, or IP; use the Platform, Service, or IP in violation of this Agreement or Laws; or reverse engineer or copy all or any portion of the Platform, Service, or IP (except as expressly permitted).

9.5 Intellectual Property Restrictions

Users may access and use the Service and the Site Content and download or print a reasonable number of copies of portions of the Site Content to which the User has properly gained access (a) solely for the User’s personal, non-commercial use, or (b) solely for the purpose of referring third parties to the Service or for compiling a collection of Space listings via the Service (a “Collection”), provided in each case that the User maintains all copyright or other proprietary notices on all copies of such Site Content.

You may not use the MyHublet logos or other digital media (“Logos”), including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion or create the impression that MyHublet endorses any product or service. You may not reproduce or use the MyHublet Marks without the prior written permission of MyHublet. In some cases, we may provide you with logos or other digital media to help you advertise your Space to potential Guests. Where provided, you agree to use Logos only to advertise your Space on our Service. You may not use any Logos, the Platform, or the Service for any unlawful or competitive use or in a manner that harms or tarnishes the MyHublet brand or reputation; and you are prohibited from modifying or using Logos in any manner that is inconsistent with our authorization or guidelines. We may terminate your right to use any Logos at our discretion upon notice to you in which event you shall cease using any such Logos.

9.6 Third-Party Rights

Some features of the Platform are services provided by third parties. For example, the map feature may be provided by Google Maps. Your use of those features is subject to that third-party’s Terms of Use. If you click on a link to third-party sites or services you will be directed to a site or service we do not control, and your use of that site or service will be subject to different terms and conditions. As part of accepting these terms, you agree to comply with all applicable third-party terms of agreement when using our platform.

9.7 Privacy

By agreeing to the Terms of the MyHublet Service Agreement, you are agreeing to the supplemental terms and policies as well, including the Privacy Policy. You acknowledge and understand MyHublet’s Privacy Policy may be updated from time to time, and governs the Platform’s collection and use of your personal information. Please see MyHublet’s Privacy Policy for more details.

Section 10: Legal

10.1 Disclaimer

We provide the MyHublet Platform, Services and all its Content (collectively “Platform) “as is” without warranty of any kind and we disclaim all warranties, whether express or implied, including without limitation, warranties or conditions of Merchantability, Fitness for a Particular Purpose, Suitability for your particular use, or Non-Infringement. Hosts, Guest, and Vendors are independent third-parties and are not affiliated, controlled by, or employed by MyHublet. Hosts and Vendors create their own listings and set their own prices, and we are not liable for the accuracy of any Space descriptions, Space availability information or Guest information. We do not endorse or warrant the existence, conduct, performance, safety, quality, legality or suitability of any Guest, Host, Host Service, Listing or Third-Party and we are not responsible for performing background checks (criminal or civil) on any of our Users.
Without limiting the foregoing, MyHublet does not represent that the Platform, Services, or Collective Content are accurate, complete, reliable, current or that they accurately represent spaces, hosts, guests, vendors, or vendor services. We do not review the condition of Spaces or whether they are consistent with their description, comply with existing law, meet applicable legal standards or any other specific requirements. We disclaim use of our Services will meet your requirements or needs or that any space is safe and suitable for your intended use. We are not responsible or liable to you or any Third-Party for provision, or for the condition or nature, of any Space, Host or Vendor Services, or any User or Third-Party Content posted or displayed on the Platform in connection with the Service. Hosts and Vendors use their own facilities and resources, and may condition use of Spaces or Vendor Services as they feel is appropriate. We do not warrant any specific results from use of the Service or a Space to Hosts, Guests or any other User and do not guarantee performance of any User or Third-Party.

We do not represent the performance or non-interruption of the MyHublet Platform itself or that the Platform and services will always be available at any particular time or location, uninterrupted or secure. We do not warrant the Platform, Content and Services are free from errors or viruses; that they will never cause you harm. We expressly disclaim that any defects or errors will be corrected, even those that we are aware of, and are under no obligation to correct errors, and we may choose to discontinue operation of the platform or service, or features of either at any time.

Although we provide rules for User Conduct and Content Guidelines, we do not control and are not responsible for what Users post, transmit or distribute on the Platform and are not responsible for any User conduct online (offensive, inappropriate, obscene, unlawful or otherwise objectionable content you may encounter on the Platform or in connection with any User Content or Third-Party Content). MyHublet also provides basic Community Guidelines but is not responsible for User conduct offline as well. This includes any Guest’s non-compliance with any terms, conditions and policies relating to the use of any Space and under no circumstances will MyHublet be responsible for any personal injury or death resulting from use of the Service, any Space, Products or Services provided by Users, or any User or Third-Party Content. You agree to assume full responsibility for the choices you make before, during and after a reservation. You acknowledge bookings carry inherent risk, and by using the Services to effect a booking, you choose to assume those risks voluntarily.

The Terms in this Disclaimer and the Service Agreement as a whole, apply to the maximum extent permitted by law. If you have statutory rights or warranties we cannot disclaim, the duration of any such statutorily required rights or warranties, will be limited to the maximum extent permitted by law.

10.2 Limitation of Liability

In no event, under no circumstance, will MyHublet (including its affiliates and personnel) nor any other party involved in creating, producing, or delivering the MyHublet Platform or any of its Content, will be liable for any damages (general, incidental, direct, indirect, special, punitive, exemplary, consequential, or otherwise) including for lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, property damage, or for any for personal or bodily injury or emotional distress arising out of, in connection with (i) these Terms, (ii) the use of or inability to use the MyHublet Platform, Services, or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, as a result of, your use of the Platform, or (iv) publishing or booking of a Listing, including the provision or use of Host and Third-Party Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not MyHublet has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.

Except for our obligation to transmit payments to Hosts under these Terms, in no event will MyHublet’s aggregate liability for any claim or dispute arising out of or in connection with these Terms, your interaction with any Members, or your use of or inability to use the Platform, any Content, or any Host Service, exceed the MyHublet Fees paid, if any by you to MyHublet, for the service in the 12 months prior to the initial action giving rise to liability. This excludes any amounts that were paid or payable to Hosts or Vendors, for use of the Platform or Services. If you are dissatisfied with the platform or services, or any content contained therein, your sole and exclusive remedy is to discontinue using the Platform and Services.

Costs & Fees:

  • Guest’s Processing Fee to MyHublet: A percentage of the space reservation cost paid to MyHublet.
  • Host’s Commissions to MyHublet: A percentage of the booking cost to MyHublet.
  • Cancellation / Refund Processing Fee: This type of fee vary by cancellation and refund roles based on condition of the cancellation and/or refund. This type of fee may include merchant service fee, processing fee and other applicable penalty fee.
  • Total Reservation Cost: This is the total payment by the Guest to MyHublet to secure a reservation.
  • Reservation Cost: This is the payment for the reservation based on increments booked (for specific hours/days) and any customized add on’s (Deposit, Cleaning Fee, Other Extras) charged by the Host on the platform.
  • Additional Fees and Disputes: Fees charged after the end of the reservations. Fees due to damages, overcapacity, extended hours and more. This request may be initiated through Disputes channel. Host is responsible to collect evidence for reason of additional fees. Additional Fees and Disputes must be reported within 72 hours after the end of the reservation.

Licenses: If applicable:

  • Right to Rent: Host must acquire all required license(s) for short term rental per local regulation.
  • Sale of Alcoholic Beverage: Host must acquire all required permission to sale directly to consumers and comply with all alcoholic beverage laws.
  • Service – any site services or related services related to the website
  • Site – website or MyHublet.com and any subsites.

Member – all users (guest, host)

Platform – portal and website

Space – listing, property, space

Surveillance: Host is required to disclose surveillance equipment in the Listing. Cameras are not permitted in private rooms, such as bedrooms or bathrooms regardless of disclosure. A bedroom set up for commercial purpose (such as photography or recording is not a categorized as a private bedroom).

Total Price – final payment by Guest for reservation.

User (Platform User) – you, guest, host

Use of Site Age Provision – must be 18 or older to use
